Theo Luật 118/2025/QH15 có hiệu lực từ ngày 1.7.2026 sửa đổi, bổ sung 10 luật liên quan đến an ninh, trật tự, người đứng đầu cơ quan chuyên môn thuộc UBND cấp xã được cấp hộ chiếu công vụ.
Trong đó Luật bổ sung các trường hợp bị thu hồi, hủy giá trị sử dụng hộ chiếu tại Điều 27 Luật Xuất cảnh, nhập cảnh của công dân Việt Nam để phù hợp với thực tiễn, gồm:
(1) Hủy giá trị sử dụng của hộ chiếu phổ thông còn thời hạn đối với trường hợp đã được cấp hộ chiếu phổ thông mới;
(2) Thu hồi, hủy giá trị sử dụng của hộ chiếu đã được cấp nhưng bị sai thông tin trên hộ chiếu;
(3) Cancellation of the validity of the passport of the person being wanted.
At the same time, adding 2 new articles (Article 31a, Article 31b) in the Law on Entry and Exit of Vietnamese Citizens stipulating the procedures for recovering and canceling the validity of the above-mentioned passport.
Previously, Article 27 of the Law on Entry and Exit of Vietnamese Citizens in 2019 stipulated 4 cases of revocation and cancellation of passport validity, including:
(1) Cancellation of the validity of the lost valid passport
(2) Revocation and cancellation of the validity of the passport of a person who is stripped of nationality, deprived of Vietnamese citizenship, or whose decision to naturalize Vietnamese citizenship is revoked.
(3) Revocation and cancellation of the validity of diplomatic passports and official passports that are still valid in cases where they are no longer eligible for use.
(4) Thu hồi, hủy giá trị sử dụng hộ chiếu đã cấp cho người thuộc trường hợp quy định tại khoản 1 Điều 21 của Luật này.
Regarding the cancellation of the validity of the ordinary passport, Article 28 of the Law on Entry and Exit of Vietnamese Citizens in 2019 stipulates as follows:
a) Within 48 hours from the time of discovering the loss of the ordinary passport, the person who loses the passport shall directly submit or send a declaration of loss according to the form to the Immigration Management Agency in a convenient place, the nearest Police agency or the Immigration control unit at the border gate or the Vietnamese representative agency abroad in a favorable place. In case of force majeure, the deadline for submitting or sending a declaration of loss may be longer, but the declaration must specifically explain the force majeure reason;
b) Trong thời hạn 1 ngày làm việc kể từ khi nhận được đơn báo mất hộ chiếu phổ thông, cơ quan tiếp nhận có trách nhiệm thông báo theo mẫu cho Cơ quan Quản lý xuất nhập cảnh Bộ Công an và người gửi đơn. Trong thời hạn 1 ngày làm việc kể từ ngày nhận được thông báo, Cơ quan Quản lý xuất nhập cảnh Bộ Công an thực hiện hủy giá trị sử dụng hộ chiếu.
